Acceptable Use Policy (AUP)

This Acceptable Use Policy (AUP) outlines acceptable and prohibited activities for Hoztlr clients. Violation of this policy may result in immediate suspension, termination, or legal action.

1. General Use

Clients agree to use Hoztlr services for lawful purposes only and are responsible for ensuring compliance with all applicable local, national, and international laws, including intellectual property laws, data protection, and any laws concerning content or services.

2. Prohibited Content

Clients are prohibited from hosting, storing, or distributing the following types of content:

  • Illegal Content: Copyright-infringing materials, counterfeit products, pirated software, or any content that violates intellectual property rights.
  • Harmful or Exploitative Content: Content related to child exploitation, violence, hate speech, or self-harm. This includes content promoting or advocating for hate, discrimination, or abuse based on race, religion, gender, sexual orientation, or ethnicity.
  • Pornographic Content: Adult content that is abusive, exploitative, or otherwise deemed inappropriate by Hoztlr. This includes content that may be legal in some jurisdictions but is prohibited by Hoztlr’s standards or conflicts with UK law.

3. Prohibited Activities

Hoztlr strictly prohibits the following activities:

  • Phishing and Fraudulent Behavior: Engaging in activities aimed at deceiving or defrauding individuals, including phishing attacks, identity theft, or financial scams.
  • Malware Distribution: Hosting or distributing malicious software, viruses, ransomware, trojans, or any other forms of harmful code that could damage or infiltrate other systems.
  • Spam: Sending unsolicited bulk or commercial emails, including but not limited to spam originating from other networks that advertise Hoztlr-hosted content.
  • Security Violations: Unauthorized access to systems, data, or networks, including hacking, DDoS (Distributed Denial of Service) attacks, or other tampering that compromises Hoztlr’s network integrity or security.
  • Network Abuse: Misusing Hoztlr’s network resources, such as IP spoofing, running bots, or any activity that impacts network performance or leads to IP blacklisting.

4. Copyright Compliance and DMCA Policy

  • Copyright Compliance: Clients are responsible for ensuring that all content hosted on their Hoztlr accounts is free from copyright infringement. If Hoztlr receives a valid Digital Millennium Copyright Act (DMCA) takedown notice or a similar copyright claim, the client must respond promptly and comply with Hoztlr’s requests for content removal or verification.
  • DMCA Requests: Hoztlr responds to DMCA takedown requests and other copyright infringement notices as a matter of policy, although this is a U.S.-specific law. In cases of copyright infringement claims, Hoztlr may require clients to remove or modify infringing content.

5. Fair Resource Usage

  • Resource Guidelines: Hoztlr’s shared resources must be used in a fair and reasonable manner. Excessive resource consumption that impacts the performance of other clients, including high CPU or bandwidth usage, may result in temporary service restrictions or a required plan upgrade.
  • Prohibited Resource Usage: Hoztlr restricts activities that strain server resources, including:
    • Running server-side processes continuously, unattended, or beyond normal usage parameters.
    • Using excessive storage for unrelated files, archives, or personal backups.
    • Running cron jobs at excessively frequent intervals.

6. Reporting Violations

Clients may report suspected violations of this AUP by emailing abuse@hoztlr.com. Hoztlr will investigate and take appropriate action, including issuing warnings, suspending accounts, or terminating services found to be in violation of this policy.

7. Enforcement and Amendments

  • Policy Enforcement: Hoztlr reserves the right to determine what constitutes a violation of this AUP and to enforce penalties as deemed necessary, including but not limited to account suspension, termination, or legal recourse.
  • Amendments: Hoztlr may amend this AUP at its sole discretion. Any significant changes will be communicated to clients via email or platform notifications, and continued use of Hoztlr services signifies acceptance of the updated AUP.

8. Limitation of Liability

Hoztlr assumes no liability for client violations of this AUP or any resulting damages. Clients agree to indemnify and hold Hoztlr harmless from any claims arising from their actions that breach this policy.
